Booking Conditions


We shall always endeavour to keep our guests holiday rental interests protected. Please read the following conditions prior to placing your booking. Receipt of a booking means you have read and are in agreement with these Terms and Conditions.

Holiday Contract

When you make a booking as Party Leader (first person named on the booking confirmation) you guarantee that you have the authority to accept and do accept and agree upon behalf of yourself and each party member these conditions. You must be at least 18 years old to make a booking with us. Your contract is made once your booking has been confirmed. It is agreed that the courts of England have exclusive juristiction to settle any dispute or claim arising out of or in connection with your booking or its subject matter, including non-contractual disputes or claims. Should any one of these conditions become invalid in whole or in part or unworkeable under law, this does not affect the validity of the remainder of these conditions.

Personal Details

We are not the owners of the booked property and we reserve the right to provide personal details of the Party Leader and party members to the owner. The Party Leader confirms that he/she and all party members consent to the use of such details as mentioned.

Payment

The booking deposit of 25% of the total booking cost must be paid to us before the booking can be confirmed, the deposit is payable at the time of booking.

The balance of the booking cost must be received at least 10 weeks before the booking start date.

If the balance is not paid at least 10 weeks before the booking start date, we reserve the right to cancel the booking. In these circumstances the booking deposit will not be refunded.

Arrival and property details will not be issued until your booking cost has been paid in full.

Late Booking

Bookings made less than ten weeks before the booking start date will be classed as a late booking, therefore the total booking cost is due upon booking.

Confirmation

Please check your confirmation email and all other documents you receive from us immediately on receipt. You must contact us immediately if any information appears to be incorrect as it may not be possible to make changes later. If you cancel or alter your booking later on, you may have to pay a charge.

Changes to your Booking

If, after our confirmation email has been issued, you wish to change your travel arrangements in any way, for example your chosen start date, we will do our utmost to make these changes but it may not always be possible. However, changes of dates may be treated as cancellations and amendments may be subject to additional charges. Any request for changes to be made must be in writing from the Party Leader.

Cancellations

To cancel the booking, the Party Leader must write to us directly and cancellation takes effect on the date we receive written cancellation. If you cancel after we confirm your booking, you must compensate us for losses, as we incur costs from the moment you make the booking. The closer your cancellation is to the departure date, the less likely we are to recover the costs by re-selling the holiday at the online rate. Our cancellation charges therefore increase as the departure date approaches, as shown below.

If you have to cancel for a reason covered by an insurance policy, any losses must be claimed directly from the relevant insurance company. Cancellation charges payable by you are:

More than 10 weeks prior to the start date - deposit

70 - 28 days prior to the start date - 70% of the booking cost

27 - 0 days prior to start date - 100% of the booking cost

Accommodation

Under no circumstances may more than the maximum number of persons (including children) stated in our booking confirmation occupy the property, except by prior written agreement with us. Failure to observe this condition is deemed to constitute a cancellation of the booking by you and we reserve the right to refuse admittance or terminate the booking and apply the appropriate cancellation charges.

Should you or any member of your party be responsible for any breakages, loss or damage of any item of the property or excessive cleaning has been necessary, a charge will be made locally or an invoice will be sent to you on your return home.

We reserve the right to deduct any charges from the breakages deposit.

Holiday Insurance

Holiday insurance is the sole responsibility of each individual party member and you are strongly advised to put this in place as soon as possible after the booking. We can accept no liability for loss, damage, personal injury or the cost of medical or other treatment.

Our Liability to you

Neither Lets Holiday Spain nor the property owner can be held liable for loss, costs, damage or failure to provide the booked property caused by an event or circumstances beyond our reasonable control including, without limitation, theft, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes, or restraints or delays affecting carriers, caused by a third party, caused by any party member or caused by any of the situations mentioned in the paragraph below. We will not accept liability if illness, injury or death is the fault of the Party Leader or any party member. If we are found liable, any compensation is limited to the amount paid for the booking after taking account of any benefit you have enjoyed of the property. We will not accept liability for personal injury or death however sustained where we have used reasonable skill and care; and/or where caused by the fault of the person(s) affected or any party member (including inadequate supervision of children); and/or where caused by the fault of a third party; and/or where caused by an event that could not have been reasonably forseen.

Accuracy

All information contained within our website has been compiled from up-to-date information, which we amend as frequently as possible with any changes. The right is reserved to modify our website and these conditions. There may be occasions when the advertised property is not available or as advertised, due to situations such as, without limitation, local circumstances, necessity for maintenance or repair, water shortages, unsuitable weather conditions, fuel shortages, power cuts, failure of sewage systems or services and other situations beyond our control. If we are advised of this we will notify you as soon as possible but we accept no liability for situations beyond our control. It is also important to remember that depending on the season, some restaurants, communal pools, water sports and water parks do not operate at all times.

Complaints

If you have cause for complaint whilst on holiday, this must be brought to the attention of Lets Holiday Spain immediately so that action can be taken to rectify the problem. Unless there is a valid reason why you failed to report your complaint whilst on holiday, we will not consider ourselves to be liable for those complaints. If the problem was not resolved during your holiday you should contact us in writing within 14 days of the end of your holiday. Notification of any complaints received outside this period cannot be considered. If you do not tell us about your complaint promptly, it may be difficult to investigate your complaint thoroughly.

Behaviour

We can end your holiday if your behaviour or that of any party member is likely in our opinion to cause distress, damage, danger to or to annoy our other guests or neighbours. In these circumstances we reserve the right to cancel your booking and we will not be liable for any refund, compensation or any other costs you have to pay. We cannot accept responsibility for the behavior of others in the property. Adults must supervise children at all times.

Swimming Pool

Children must not use the swimming pool without adult supervision.

Pets/Animals

Unless otherwise advised, pets and animals are not permitted in the property.

Access

We, and those we may authorise, must be permitted to enter the property at all reasonable times to inspect the property or contents, carry out necessary repairs and maintenance to the property or to take meter readings.

Breakages Deposit

We require a refundable security / breakage deposit of £200.00 per booking which is payable with your balance payment, unless otherwise stated.

This deposit will be returned to you in full after departure, providing no breakages or damage have been found or reported. Any chargeable costs will be advised and we reserve the right to retain the security deposit (either in part or full) to cover breakages, damage, non return of keys and excessive cleaning costs for spills, stains etc. Guests are expected to leave the property in a clean and tidy condition.

Please advise of any faults and damages on your departure. Receipts for repairs or replacements will be provided in the unlikely event that such retention of the security deposit is required. You are responsible for any damage or breakages that may be caused to the property and its contents during your stay. Please report all damage and faults caused or found at the property at the earliest opportunity.

Accommodation Courtesy

While you are on holiday we ask that you respect the condition of the property and ensure that standards are maintained. You are on holiday and are not expected to clean the property but you are required to leave it in a clean and tidy condition and to remove any stains and replace items damaged by party members. We would also request that you remove your household waste to a local bin.

Occupancy Times

For cleaning purposes properties may not be ready for occupation before 4.00 pm and must be vacated by 10.00 am unless otherwise agreed with us.

On Arrival

As our properties are registered with the Andalucian Tourist Board, and as a requirement of legislation, you will be asked upon arrival for the Passport details of each party member.  The passport details have to be passed to the local authorities.
